FAMILY LAW APPELLATE PRACTICE

Litigation in Superior Court is vastly different from a proceeding in the Appellate Courts. The Superior Court has determined the facts. Courts of Appeal assume that the decision was correct and it is up to the appellant to demonstrate that there has been a substantial error made. Despite popular opinion, appellate courts do not re-try cases. Most appeals are not successful. You should be entitled to know the viability of your case before you pay for an appeal. Therefore, our philosophy is that we should review the case first to determine the viability before you proceed with the appeal. Mastery of all applicable law, and an intimate knowledge of all cases that come down from the Appellate and Supreme Courts in the area of Family Law are important aspects of the way we practice.
